Terms and Conditions

Article 1: Definitions

1.1. Unless stated otherwise, the following terms are defined as follows:

  • Surfcoaching Business: Refers to Wibi Surf, which offers surf coaching services to individuals, groups, companies, and other parties.
  • Representative: Any individual acting on behalf of Wibi Surf (e.g., coach, instructor, or other staff).
  • Client: The party entering into an agreement with Wibi Surf, including any individuals participating on their behalf.
  • Activity/Arrangement: Any service, event, or session organized or provided by Wibi Surf, including but not limited to surf coaching and training sessions.

Article 2: Applicability

2.1. These Terms and Conditions apply to all offers, agreements, quotations, and activities carried out by Wibi Surf.

2.2. By entering into an agreement or participating in any Activity/Arrangement, the Client acknowledges and accepts these Terms and Conditions. This also applies when third parties are involved in the execution of services.

2.3. Any deviations from these Terms and Conditions must be agreed upon in writing. If any provision is declared null or unenforceable, the remaining provisions will remain valid. The parties will then replace the invalid provision with a new one that aligns with the intent of the original.


Article 3: Bookings, Payments & Refunds

3.1. Coaching sessions must be booked and paid in advance.

3.2. All prices published via Wibi Surf’s official channels include VAT.

3.3. Wibi Surf reserves the right to reschedule sessions (e.g., due to unsuitable weather or wave conditions). In such cases, the Client will be informed promptly, and an alternative date/time will be proposed, taking the Client’s availability into account.

3.4. Cancellations must be communicated at least 24 hours in advance. If notified on time, no costs will be charged. Cancellations made within 24 hours of the session are non-refundable.

3.5. Wibi Surf is not liable for typographical or programming errors on its website or other communications.

3.6. No refunds are given in cases of long-term injury; however, sessions may be rescheduled upon mutual agreement.

3.7. Refunds are not available if:

  • The Client has had a fair opportunity to attend the coaching.
  • The request for a refund is made more than 14 days after payment.

3.8. Discounted or special deal bookings are strictly non-refundable (as per Clause 3.7).

3.9. Participation in a coaching session is only confirmed once full payment is received at least 24 hours before the scheduled session.


Article 4: Equipment and Skill Requirements

4.1. Wibi Surf does not provide or rent surf equipment.

4.2. It is the Client’s responsibility to ensure equipment is arranged in advance and brought to the session.

4.3. Wibi Surf accepts no liability for personal injuries or property damage to the Client or third parties.

4.4. A minimum swimming certification (e.g., Dutch diploma A) is mandatory.

4.5. Clients must be capable of identifying and managing rip currents.

4.6. Clients must understand and apply internationally recognized right-of-way rules taught in certified beginner surf schools.

4.7. Before participating, Clients must be capable of:

  • Paddling through surf to the backline,
  • Catching and surfing unbroken waves (left and right).
    Assessing their ability to meet these conditions is the Client’s responsibility.

Article 5: Applicability to Other Activities

5.1. These Terms and Conditions apply to all activities and services offered by Wibi Surf.


Article 6: Gift Cards & Vouchers

6.1. Gift cards and vouchers issued by Wibi Surf are non-refundable and cannot be exchanged for cash.


Article 7: Risk and Liability

7.1. The safety of all participants is a top priority.

7.2. Participation and use of equipment (whether rented elsewhere or personally owned) are entirely at the Client’s own risk.

7.3. Clients must comply with all safety instructions issued by representatives of Wibi Surf.

7.4. Clients are responsible for attending any theory or safety briefings provided.

7.5. Wibi Surf is not liable for any accidents, injuries, or damages incurred during participation. Clients acknowledge that participation involves inherent risks and waive all rights to hold Wibi Surf liable.

7.6. In the case of minors, parents/guardians are responsible for providing accurate information and assume full liability.

7.7. Individuals with medical conditions (e.g., neck/back problems, heart conditions, pregnancy), or under the influence of medication, drugs, or alcohol, are strongly advised not to participate. Wibi Surf is not liable for resulting consequences.

7.8. Wibi Surf accepts no liability for incidents arising from:

  • Steering errors,
  • Equipment defects,
  • Collisions,
  • Reckless behavior.

7.9. Clients may be held liable for damage or injury caused by reckless or intentional misconduct during sessions.

7.10. Participation is entirely at the Client’s own risk. Wibi Surf is not responsible for any physical or material loss, injury, or damages incurred during coaching or related trips.


Article 8: Force Majeure

8.1. “Force majeure” refers to events beyond the control of Wibi Surf that prevent it from fulfilling its obligations (e.g., extreme weather, natural disasters).

8.2. In such cases, activities may be paused and rescheduled in consultation with the Client.


Article 9: Media, Privacy & Copyright

9.1. Wibi Surf may use video and photography equipment for safety and marketing purposes. All rights to such recordings are retained exclusively by Wibi Surf. Participants waive any claim to these rights.

9.2. All intellectual property, including materials and media, remains the property of Wibi Surf and is protected under applicable copyright law.


Article 10: Governing Law and Jurisdiction

10.1. These Terms and Conditions are governed by Dutch law.

10.2. Any disputes will be exclusively submitted to the District Court of The Hague, unless mandatory legal provisions dictate otherwise. Wibi Surf retains the right to bring proceedings before any court with jurisdiction under applicable law.


By submitting payment, entering into an agreement, or participating in any Activity/Arrangement, the Client confirms they have read, understood, and accepted these Terms and Conditions.

Article 11: Surf Trips

These Terms and Conditions apply to all bookings for the surf trip to Spain organized by Wibi Surf. By booking, the participant agrees to the terms outlined below.


11.1 Scope and Acceptance

These conditions govern participation in the surf trip to Spain organized by Wibi Surf. By completing a booking, the participant confirms they have read, understood, and accepted these Terms and Conditions.


11.2 Booking & Payment

  • A booking is considered final only after full payment has been received by Wibi Surf.
  • Full payment must be made at least 7 days prior to the trip’s start date.
  • Failure to pay on time may lead to automatic cancellation of the booking, without refund of any amounts already paid. Wibi Surf may enforce this without further notice.

11.3 Cancellation by the Participant

  • Cancellations must be submitted in writing via email to: info@wibisurf.com
  • The following cancellation fees apply:
    • Up to 14 days before departure: 25% of total trip cost
    • 13 to 7 days before departure: 50% of total trip cost
    • Less than 7 days before departure: 100% of total trip cost
  • Participants may recover part of the costs through personal travel or cancellation insurance, if applicable. Wibi Surf is not responsible for any insurance reimbursement.

11.4 Cancellation by the Organizer

Wibi Surf reserves the right to cancel the trip due to force majeure or events outside its control, including but not limited to:

  • Natural disasters
  • Extreme weather
  • Governmental travel restrictions or health emergencies

In such cases:

  • All amounts paid will be fully refunded.
  • Wibi Surf is not responsible for any additional costs incurred by the participant (e.g., flight tickets, accommodations not included in the trip package).

11.5 Travel Documents & Insurance

  • Participants are responsible for ensuring they possess a valid passport or national ID for travel.
  • Wibi Surf strongly recommends obtaining:
    • Travel insurance
    • Cancellation insurance

These insurances are not included in the trip cost and must be arranged by the participant.


11.6 Liability and Risk

  • Participation in the surf trip is entirely at the participant’s own risk.
  • Wibi Surf is not liable for injury, loss, or damage, except in cases of gross negligence or intentional misconduct.
  • Wibi Surf is not responsible for:
    • Injuries from inherent risks of surfing
    • Accidents resulting from the participant’s own negligence
    • Incidents during non-organized or unsupervised activities

Participants must follow all instructions from surf coaches and local authorities.


11.7 Program Changes

Wibi Surf reserves the right to make changes to the itinerary or daily schedule due to:

  • Safety concerns
  • Weather conditions
  • Other unforeseen or uncontrollable circumstances

Where possible, Wibi Surf will provide suitable alternatives and inform participants in a timely manner.


11.8 Health and Fitness

By booking, the participant declares that they are physically and mentally fit for surfing and all other activities during the trip.

  • Any relevant medical conditions must be disclosed prior to departure.
  • Wibi Surf reserves the right to exclude participants from specific activities if their participation poses a health or safety risk to themselves or others.

11.9 Governing Law and Dispute Resolution

  • These surf trip terms are governed by Dutch law.
  • Any dispute arising from or related to the surf trip will be resolved by the competent court in the Netherlands.
